Clementi Report
Published in December 2004, the Clementi Report focused on three keys areas of reform:
- the existing regulatory framework of the legal services with emphasis on its complexity, inconsistency and insufficient regard for consumer interest
- the current complaints system in respect of its efficiency, and the principle of lawyers overseeing complaints against other lawyers
- the restrictive nature of current business structures, including restrictions on ownership and management of law firms, and on lawyers working with other lawyers or with other professionals
The main Clementi recommendations included:
- the establishment of a new regulatory framework including the creation of two new bodies: a Legal Services Board to oversee front-line regulators such as the Law Society and the Bar Council, and an independent Office for Legal Complaints to handle consumer complaints.
- setting out statutory objectives for the Legal Services Board
- increasing competition in the delivery of legal services by permitting new alternative business structures (ABS)
