White Paper
Following Sir David Clementi’s report, in October 2006 the Government published a White Paper to:
- end the current regulatory maze
- establish a system of regulation that would act in the interest of consumers and be independent of Government and the legal services providers
- create a new, transparent and accountable system of legal services delivery
To achieve these objectives, The Government proposed:
- to establish a new regulatory framework and simplified regulation of legal services by creating a Legal Services Board to oversee front-line regulators such as the Law Society and the Bar Council
- to encourage new ways of delivering legal services to promote competition and remove unnecessary restrictions by allowing alternative business structures (ABS) to be formed
- a fairer complaints handling procedure to be overseen by the formation of an independent body: the Office for Legal Complaints
- the cost of implementing the reforms be borne by the legal profession
